Fury over reported federal plan targeting transgender people

Caitlyn Jenner has given a scathing response to President Donald Trump's controversial memo targeting transgender people.

The Department of Health and Human Services (HHS) is looking into establishing the legal definition of sex under Title IX as a biological, immutable condition determined by genitalia at birth, a memo obtained by the New York Times showed.

The department's proposed definition of gender would define sex as either male or female, unchangeable, and determined by the genitals that a person is born with, according to a draft reviewed by The Times.

The reported proposal comes little more than a week after New York City created a gender-neutral "X" option for birth certificates, joining California, Oregon, Washington state and New Jersey in offering a third gender category on the government-issued identity documents.

Bob Stith, the Southern Baptist Convention's former national strategist for gender issues, told Baptist Press nonsensical arguments from transgender activists should spur Christians "to be thoughtful and compassionate".

In the United States, an estimated 1.4 million people identify as "transgender", self-identifying as a gender other than the one recorded at birth. A "no" vote would repeal the law. The goal of the redefinition is to deny transgender people protection under federal civil rights law that prohibits discrimination on the basis of sex.

"HHS's blaming the Obama administration and their reliance on a terribly flawed and now dissolved preliminary injunction that was and remains in conflict with the overwhelming majority of federal courts which have held that, properly construed, Title IX protects transgender students is shocking", Davidson said. "And if they were to propose such a rule, [we] would work aggressively with others here in MA and other states to see if we can get them to change their mind". The Administration's plans are in direct conflict with a growing trend in federal court decisions affirming that sexual orientation and gender identity are covered under our nation's civil rights laws which prohibit discrimination based on "sex". If the Justice Department considers the revised definition legally viable and enforceable, HHS can then approve and implement it as policy across a range of government agencies involved with Title IX enforcement. "The Trump administration is going to get a can of whoop-ass from me!"

"The Trump administration is not defining people 'out of existence, '" as a Times headline announced, Walker said.

Psychiatrists no longer consider being transgender a disorder and several US courts have found the Obama interpretation of protecting transgender people against discrimination as sound.
